Late last year, some factory-farm employees got their pink slips from Aviagen Turkeys, Inc. in response to PETA's undercover investigation, which documented that workers were breaking turkeys' necks, stomping on their heads, and shoving feces and feed into turkeys' mouths.

Then, in February, a grand jury handed down 19 indictments, including 11 felony charges, against three former Aviagen workers, marking the first time in U.S. history that factory-farm employees have faced felony cruelty-to-animals charges for abusing birds.

Fast forward: Two of the three ex-employees, Scott Alvin White and Edward Eric Gwinn, recently pleaded guilty to cruelty charges. On June 8, White was sentenced to serve one year in jail—the maximum period permitted by law! Today, Gwinn was sentenced to serve six months' home confinement—the maximum period permitted by law—on each count, concurrently, and is banned from living with, owning, and working with animals for five years. The case against the third ex-employee, Walter Lee Hambrick, is pending.

Can't get enough? In September, a grand jury in neighboring Monroe County, West Virginia, may well issue further felony indictments against White and Hambrick.

These historic victories by no means even the score for the turkeys who were punched and thrown or the many other birds who suffered when they were forced to watch as other turkeys were abused at Aviagen. After watching our undercover video, animal behavior expert Dr. Lesley J. Rogers stated, "It is now known that when social animals, like turkeys, see and hear other members of their species under stress or suffering physical injury, their levels of stress become elevated. Hence, the behavioural stress is widespread in the birds in the vicinity of those that have been injured and/or handled roughly."

Still, these convictions will remind workers on other factory farms that if they don't clean up their acts, PETA investigators (and the whistleblowers who tip us off) will have their eyes on them.

No matter what these lowlifes get, it will NEVER be enough. So many animals keep suffering at the hands of the lunatic few. But as long as judges and people generally do NOT respect the lives of animals, they will continue to get away with neglecting and abusing them. As a so called CIVILIZED SOCIETY, we need to step up the legal sentencing on those who do such despicable things to innocent creatures. Evil can only triumph when GOOD people sit by and do nothing. Okay... Yay turkeys but, really? 1 year or less? Committing an act such as those is SERIOUSLY f*cked up! These people have severe mental health problems. They're probably abusing other things besides animals. They need to be locked up in a mental institution. I don't mean to be a downer but that's a slap on the wrist. I am very happy we now prosecuting and convicting these criminals but it really feels like a slap in the face when I read the time - 6 months? hardly time to contemplate on the cruelty of the act.

I actually feel sorry for these guys. I think the executives at Aviagen Turkeys, Inc. should be the ones in jail, as they set the precedent. I highly doubt these men are the only ones abusing the turkeys like this, and I bet it was condoned by other employees, particularly supervisors. Those people should be in jail. How are they to know to behave differently if their behavior is condoned by their peers? The justice system is not just in the least. OK, start flaming me now.

I am so happy to read about this news. I happen to eat turkey on occasion. However, that does not mean I condone any kind of cruelty to animals. There is absolutely no reason these animals have to be tortured. No reason and no excuse. I hope this verdict is a step toward even more rights for farm animals. Good work, PETA: it is great that they got something, but still it is a pretty pathetic sentencing. Banned from animals for five years? Once the five years is up, he'll go right back to doing that! The law is a load of crap. I hate petty jail sentences and meaningless bans, the only way to make these people stop is to do to them what they did to the animals! Break their feet, throw them off a roof, burn off their noses! It's the only way they'll see justice!

This is brilliant news. something has to change though. 5 years of not being allowed to work with animals is not good enough. THEY SHOULD NEVER BE ABLE TO WORK WITH ANIMALS AGAIN. do not tell me, that behind closed doors and when people's backs are turned, that these evil *astards won't hurt an animal ever again. This best possible sentence would have been to have thase people do community service for an animal welfare organizarion. LEducation is the key to chenge. The factory environments are iey to permitting cruelty or any behavious. Therein lies the fix. We need to keep up the pressure on the government to enforce by way of community work for animals and fine the owners of the factories. Society will always consume animal food, We have to create safe and humane environments for the animals.

I am just watching the 4.30pm news in Australia and there is no mention of these atrocities, not now or ever, how come all these animal cases never get to make the news, its like they don't classify this as news worthy, cause it is too horrible, thats why, I hate all the hypocrisy that goes with all this stuff, if only it was on the news then hopefully people would make the connection and not eat animals!

Sitting in South Afica where we love animals so much, just breaks my heart to see this kind of inhumane behaviour, I can not imagine what pain this poor Turkey has to endevour when he lands in this sick species hands. at last some justice for beutifull inteligent animals althought they should have got more for it... i think the USA needs to update their animal welfare laws, england reveiw and update their laws constantly you cant get away with any thing here its even illegal to dock a dogs tail unless its a working dog n then ur only aloud to dock 1/3 of it animals have feelings to and should be treated the same as people within reason

This is a triumph indeed, although it doesn't seem like a very long time... This does makes a statement towards other animal-abusers and is scary enough perhaps for them so they stop their abuse and maybe realize that these punishments are the logical consequence for their idiotic actions. I am happy for this news and it gives us hope for the future that other animal abusers await a similar sentence... because in the past a conviction on these grounds, how pathetic that is, was very rare...

Finally - the tide is beginning to turn. As was so wisely said above - people who treat animals this way have some sort of mental disorder/disease.

The prosecutors of these cases should remember that some of the most notorious serial killers of our time - Charles Manson and John Wayne Gacey (For example) both had a history of torturing animals.

Perhaps if this behavior was taken more seriously - then it wouldnt be given the chance to escalate in the future.

I don't think it is enough punishment but at least it is a start and people are becoming more aware of what goes on in these factory farms. The people I work with can't believe some of the stuff I tell them. Just have to keep pushing forward.

I wonder if those men regularly ate/eat turkey after taking part in their pre-slaughter torture. Forcing them to do so for the next five years would have been interesting. As would have many hours of community service working at the local understaffed animal shelter. Their bosses are the ones who deserved jail time, BIG fines, and being barred from producing meat of any kind for five years. Maybe they'd have to eat beef from downer cows for the duration too.

The attention is vital to the cause, so please PETA, keep up the hard work no matter what the detractors say. Justice's remedies may be paltry today, but we must keep seeking it for those creatures who deserve it!

I'm sure these people are only the tip of the iceberg when it comes to animal cruelty. These type of people are without a soul or they wouldn't be capable of such cruelty to other living creatures - in other words they are evil. I believe our attitude towards other living creatures, is a measure of our worth in the spiritual scheme of things.
My opinion on the true role of humans as protectors of animals and nature, may seem a little out-there to most. We certainly have a long way to go yet, but much tougher laws in regard to animal cruelty are needed.

this is a huge victory for the animals, think about it!How many times have judges and courts let these monsters go free. without conviction or consequence. i am grateful that we got these convictions and i hope that there is many more to come. positivity is all we have.

Great to hear they finaly got a conviction.I personly don't think it's enough time but it's a start.I have been raising poultry for 5 years.All of my bird's are for pet's and "eye candy".If anyone did something like to one of my bird's I'd be giving them the same treatment back!

What wonderful news - finally, some justice for those innocent birds. Factory farms are living hells for the animals imprisoned in them until they are taken for slaughter. Did God give us animals to treat in this manner? The answer is an emphatic "NO!!" I am so thankful for organizations like PETA and for all those who help to rescue animals and who campaign endlessly for animal rights. We have to get these factory farms shut down as soon as possible. We need to educate people that meat is not a necessary part of our diets and that we can be much kinder, happier and healthier by not eating our fellow creatures.

Finally! Justice for these poor animals that give their lives to feed EVERYONE! I just wish the penalties could have been more harsh and equal to the pain and torture these poor turkeys were forced to endure.

And people say that Auschwitz is only in the past and a memorial!

For years I have been asking and conferring with different people and "professionals" asking them if the reason for the high number of humans suffering so many diseases are the result of animals being abused, tortured and their anxiety levels being "upped"? We CONSUME these animals and their chemical-tainted flesh and believe this to be "normal"? No! Animal abuse has NO place in any society, in any country, and be accepted by any "civilization".

But I am Happy that these Two-Legged Monsters will pay for what they did, and I hope they pay double when they take their last breath in this life.

I have stopped eating beef,poultry and pork for this very reason. Whatever sentences these scumbags get is not enough. They should be glad that the law caught up with them before I did! I would make them suffer !!!! It is a start however and for that I am grateful. I have been an animal lover my entire life and have more cats than a sane person should have. I take care of my animals. They own me!!!! They are all spayed and neutered,go to the vet when they need to and are well fed and always have clean water. If someone ever abused one of my kitties,they wouldn't live to tell about it. I also have a few special needs cats as well. I don't mind tending to them at all. So,I am much happier eating a morningstar riblet sandwich or having a pizza made with boca itallian sausage. I can do without meat because I don't think that ANY animals should suffer. I also spend the extra$$$ to get eggs from chickens that aren't caged and are taken care of properly. That's just my 2 cents..

Great news, I agree...but the real problem lies not with individual brutish psychos, but with the whole system of animal rearing, in factory farming conditions, for the purpose of slaughtering and eating them...it has the effect of brutalising those who work in the system. Sadly, I found the newspaper accounts of this trial, and the comments by readers at that site. They DON'T get it. Most were puzzled by why these men would be convicted when the turkeys were just going to die anyway. The problem is the desensitization of people who see birds and mammals as food, and do not want to know how these poor creatures got on peoples' plates. Keep up the good work, PETA! I always challenge those who tell me 'vegetables have feelings too' by telling them I am happy to see my food from garden to table, but can they watch a turkey, cow or pig endure the horrible conditions from birth to death to dinner plate?

We all agree that 6 mths, 1 yr, 5 yrs are just NOT enough and it's outraging that people still don't get it and considerate it an "out-of-proportion sentence" (hello..?!!). Nevertheless I'm very glad for this small but significant triumph. It's a huge step, considering that most people don't take serious our cause. In answer to your question, michael k reily, the reason the death penalty is sometimes a desireable option, is to completely eliminate the possibility of reoffending. as well, obviously, as an acknowlegement of the extreme seriousniess of the evil act There are not many crimes which I would regard as worthy of the death penalty, however, malicious, needless, sadistic cruelty is beyond criminal, it is unspeakably evil, a sin, for which I consider there should be no forgiveness. I'm guessing you are one of those humans who regard the lives of other living beings as somehow less important than human life, I wonder if you would feel differently if it were your own child who was abducted, tortured and killed by a vile sadist? I personally do not rate human life more highly than that of the other beautiful beings who share this planet with us. If we have a purpose here, it is to be the guardians of the planet and all the amazingly designed and beautiful beings who share our world, and, perhaps to be a little less critical about the spelling issues of others, bearing in mind, that not everyone may be as gramatically perfect as you and that, in itself, is a trivial issue, when the person is making a stand for the rights of other living beings!! It was gratifying to read all of the comments posted. The concerns expressed and the participation seem to be increasing and they should be. These disgusting dimented individuals need to suffer the consequences of their actions. Abusing animals should be punished in the same manner as child abuse and murder are. Life is a constant change and that change includes law, which should be more stringent pertaining to animal abuse. I'd like to see the same manner of punishment be inflicted on those individuals i.e. forcing feces down their throats, etc. This type of behavior is beyond cruel and needs to be treated as a crime rathar than a minor punishment.

Thank God PETA's voice was "heard"! People who abuse any kind of creature even in the name of science (ie.lab testing), they are not just heartless, they are perverted sadists, as if they have descended from those inquisitors and executioners of the middle-ages and even worse. Such people should be permenantly put under both police and psychological/medical observation because what they do to helpless animals is because they cannot do to human beings.

i cried when i read this. Tears of joy. It is sum kind of justice and is one step closer to ending the abuse and exploitation of factory farm animals. I think they need to serve longer sentences, get raped severely in jail, and be killed in the worst way. I have zero tolerance for animal abuse. I cussed out a child for scaring away pigeons when they were eating the bread i was giving them. I should have threw him in the pond.

To the proud people of PETA who do such a great Job!!. I am a longstanding member and proud to see where animal abuse is corrected. Shame the people don't get treated just like they did the animals.!! justice would be for them to be tortured like the animals! So proud to be a member.!!!!

This is a huge step forward! However, the sentence is slight compared to the crime. Punishment needs to fit the crime! That is what we need to emphasize now. Harsher penalties for abuse and neglect of any animal! On top of thier punishments, they should have to make a sizable donation to PETA! To help punish more sadists for thier sick deeds. Also they should NEVER, I mean NEVER be allowed near another animal! We need to create an animal predator list, similar to the one that protects our children from abusers. We need that protection for our animals. They would need to regester themselves as an animal abuser, and may thier neighbors hand out the punishments that our courts will not!

It is great that the courts have recognized these acts as criminal. I do, however, feel that wishing for harsher retaliatory measures against those guilty is also a symptom of the greater problem. I have recently watched a film called "Earthlings" which delves into the various ways humans dominate, disrespect, kill, and torture animals for self gain. There is a widespread sickness thriving in our societies...and while it is easy to label these few convicted from the article above as "evil", it does nothing to address the source of the problem, and in fact makes it easier to continue hiding behind the "few bad seeds" facade. The way we currently treat animals on this planet is disturbing, and almost all of us participate, either directly or indirectly by what we choose to eat, wear, or find amusement in...even if it's as simple as spending money on a zoo/circus, places that disregard an animal's right to live it's life in a natural habitat and force them to do unnatural things for our amusement. As the dominant species, it is our responsibility and ability to ensure all other living things can have a chance at a long, happy life...and we are miserably failing at this task.

What kind of homes did these maniacs come from? People who are f***ed up in the head like that should be sterilized so as not to bring about any more of their kind into society. One year is NOWHERE near long enough for these sorry excuses for human beings. God gave us these brains and our humanity for a reason. We were given the responsibility to speak out for these other creatures with whom we share this earth - we must respect all God's creatures. God bless PETA!

I was the one who reported the abuse.I went several sleepless nights due to graphic and horrible treatment to the animals.I witnessed a girl stealing 2 poults which she had to put them in her lunch box with a towel to smuffle their chirps.This place was horrible and I would'nt recomend anyone working there unless you enjoy cruelty to animals.Supervisors orders...
